Revised requirements for lost paper Certificates of Title applications – Section 31

From 4 May 2026, a supporting statutory declaration is no longer required to be lodged with a Subscriber-lodged application under section 31 of the Transfer of Land Act 1958 (lost or destroyed paper Certificate of Title).

The Registrar will rely on the certifications given by the Subscriber in the electronic instrument. If the Registrar considers further information is required to support registration, the Registrar may request a statutory declaration or other supporting material.

Subscribers remain responsible for ensuring the application is correctly made and that appropriate evidence is held to support the certifications given. Subscribers may be subject to compliance examinations.

Availability of issue records for Certificates of Title

Land Registry Services advises that issue records for Certificates of Title are available in computerised form from 1984 onwards.

Where no computerised issue record can be located for a folio, this indicates that the last issue of the Certificate of Title occurred prior to 1984. Historical paper-based issue records prior to 1984 are no longer available for search or enquiry purposes.

Subscribers and customers are not required to make further enquiries regarding pre-1984 issue information where no computerised record exists.

This applies to all transactions and enquiries where confirmation of an issue record is sought.
